Senate Advances Sweeping College Sports Bill With Major NIL and Betting Implications

College Sports Bill The U.S. Senate moved a major college sports overhaul closer to passage Tuesday, advancing legislation that could establish national rules governing athlete compensation, transfers, eligibility and sports wagering violations. Senators voted 74-24 to invoke cloture on the motion to proceed with S. 4668, the bipartisan Protect College Sports Act of 2026. The procedural vote clears the way for the Senate to debate the legislation and eventually hold a final passage vote. The bill is led by Sens. Ted Cruz, R-Texas, and Maria Cantwell, D-Wash., along with Sens. Eric Schmitt, R-Mo., and Chris Coons, D-Del. The measure previously advanced through the Senate Commerce Committee by a 19-9 vote in June. Supporters say federal legislation is needed to bring stability to a college sports system transformed by NIL payments, revenue sharing, the transfer portal and repeated litigation over NCAA rules.

What Is the Protect College Sports Act?

The legislation would establish a federal framework for several of the largest issues confronting college athletics rather than leaving schools and conferences to operate under varying state laws and court decisions.

NIL and Athlete Compensation

The bill would codify athletes’ right to earn compensation from their name, image and likeness while creating national standards for NIL agreements. The revised legislation also reinforces the revenue-sharing cap created by the House settlement and creates a separate retention fund that can reach $27.5 million if schools make qualifying investments in NIL opportunities for women’s and Olympic sports. Athletes would also receive federal protections involving scholarships, healthcare and NIL contracts. Agents would face registration requirements and restrictions on the fees they can collect.

Transfers, Eligibility and College Sports Spending

The legislation would create nationwide eligibility and transfer standards, including a five-year competition limit and protections for one transfer without loss of eligibility. It also contains restrictions on midseason coaching moves and provisions designed to prevent schools from circumventing compensation limits. Supporters argue those measures would create more stability and help control escalating athletic spending. Cantwell released an analysis Wednesday finding that general-fund support for athletics among Power Four universities increased from $445 million in 2015 to $1.2 billion in 2024. The proposal has also drawn opposition. Some senators and athlete advocates contend that limits on compensation and the legislation’s legal protections for college sports organizations could restrict athletes’ economic and legal rights.

How the Bill Could Affect Sports Betting

The legislation does not create a new federal framework regulating sportsbooks or change which states can offer legal sports betting. Its wagering impact instead centers primarily on athlete eligibility and the enforcement of gambling rules.

Betting Violations Could Carry Clearer Eligibility Consequences

The revised bill specifically clarifies that college athletes who engage in sports wagering can have their eligibility restricted. Importantly, the provision also encompasses event-contract platforms such as Kalshi and Polymarket, addressing the growing debate over whether trading sports event contracts should be treated differently from traditional sportsbook wagering for eligibility purposes. That issue became especially significant following the Brendan Sorsby case. Sorsby acknowledged wagering on college and professional sports, including Indiana football while he was on the roster, but obtained a preliminary injunction preventing the NCAA from declaring him ineligible. The NCAA argued that provisions of the Protect College Sports Act could restore clearer authority to impose eligibility penalties for wagering violations.

Integrity Could Matter to Sportsbooks

For regulated sportsbooks, the bill’s direct operational effect appears limited because it does not establish new federal sportsbook licensing, taxation or wagering-market requirements. The potential impact is instead tied to competitive integrity. College betting markets rely heavily on confidence that athletes are not wagering on games in which they participate or manipulating outcomes. The NCAA announced in June that four former Alabama State basketball players were permanently ineligible following violations involving game manipulation for sports betting purposes. By giving college sports organizations clearer statutory authority over wagering-related eligibility, the legislation could reduce some of the legal uncertainty surrounding enforcement. It could also put sports event contracts offered through prediction-market platforms under the same eligibility umbrella as other forms of sports wagering for college athletes.

Bill Still Faces Additional Votes

Tuesday’s 74-24 vote was a significant procedural victory, but it did not constitute final Senate passage. The legislation still must clear further Senate consideration before moving to the House. If ultimately enacted, the Protect College Sports Act would represent one of the most substantial federal interventions in college athletics, establishing nationwide rules covering everything from NIL compensation and transfers to media rights and sports-betting-related eligibility.
