Congress Presses MLB, FanDuel Over Bryce Harper Sports Betting Video

Sen. Richard Blumenthal of Connecticut and Reps. Paul Tonko of New York and Valerie Foushee of North Carolina sent letters to MLB, the MLB Players Association and FanDuel concerning the incident. The lawmakers called on MLB and the union to prohibit promotional arrangements involving players and sportsbook operators and urged FanDuel to eliminate its VIP program. The controversy stems from a personalized Harper video reportedly sent to a bettor who said he lost approximately $1.5 million wagering with FanDuel. The customer received the video as part of his relationship with the sportsbook’s VIP program.

Harper Says He Didn’t Know Video Was for FanDuel

An important element of the controversy is Harper’s assertion that he didn’t knowingly record an advertisement for the sportsbook. Harper said he believed he was creating a personal holiday greeting for a fan through Cameo. He has disputed the idea that he knowingly participated in a gambling promotion, saying he had no reason to believe the recording would subsequently be used commercially by a sportsbook. That distinction has become central to the debate. The lawmakers aren’t simply questioning Harper’s involvement; they are examining the broader policies that allowed a personalized message from a prominent MLB player to reach a high-value sportsbook customer. In their letter, the lawmakers described the situation as a failure of safeguards surrounding sports betting promotions and called for changes to prevent similar incidents.

Congress Wants Changes From MLB and FanDuel

The lawmakers are pushing MLB and the MLBPA to reconsider policies allowing players to participate in promotions connected to sports betting companies. They also want the issue addressed as part of collective bargaining discussions and requested responses by Aug. 24. FanDuel faces a separate request to end VIP programs that reward high-value customers. Critics of such programs argue that personalized incentives, bonuses and direct communication can encourage customers to continue wagering even when their gambling behavior becomes problematic. The incident could therefore have implications well beyond one video. Sportsbook partnerships and advertising have become highly visible across American professional sports since the Supreme Court overturned the federal sports betting prohibition known as PASPA in 2018.

MLB’s Sports Betting Relationships Face New Scrutiny

MLB has maintained partnerships with regulated sports betting companies while simultaneously establishing rules designed to protect game integrity. The Harper controversy raises a different question: how closely should players themselves be connected to sportsbook marketing? The congressional request could increase pressure on MLB to draw a clearer line between general league-level sportsbook partnerships and individual player promotions. The situation also illustrates the distinction between regulated sports betting itself and marketing practices used by licensed operators. The lawmakers aren’t calling for an end to legal MLB wagering. Instead, their concerns center on how sportsbooks market to customers, particularly high-volume bettors and those who may exhibit signs of problem gambling. For MLB, the challenge will be maintaining relationships with a lucrative legal betting industry while ensuring that player images and endorsements aren’t used in ways that could undermine responsible gambling efforts or public confidence.
